分享经济全新的生产组织形式改变了传统的用工方式和劳动关系,其低门槛、高灵活性、去劳动关系化的特点给劳动者就业状况、就业观念、社会保障、就业保护、劳动权益带来很大的影响和挑战,政府部门应及时介入,审慎监管,引导分享经济平台合理用工,在为劳动者创造就业机会的同时,提高劳动者就业质量;工会应突破现有法律限制,将灵活就业人员组织起来,通过行业协商、民主参与、法律援助等形式维护劳动者合法权益。
<<The brand-new way of production organization in the sharing economy has changed the traditional form of employment and labor relations. Its low threshold,high flexibility,untying of labor relations and other characteristics make major effect on and pose serious challenges to the laborer’s status and conception of employment,social security,workplace protection and labor rights. The government should engage itself into it timely with prudent regulation and proper guidance for the rational employment and the creation of jobs through the platform of the sharing economy,meanwhile,and at the same time make an effort to raise the quality of employment. The trade unions should help to lift the legal restrictions with the view of organizing the laborers of flexible employment to defend their legal rights through industrial consultation,democratic participation,legal assistance,etc.
