当前,北京市、广东省、上海市、陕西省、河南省、四川省、福建省、山东省、河北省、江苏省十个省、直辖市成立了地方立法学研究会。“是否成立省(自治区、直辖市)法学会立法学研究会”以及“研究会会长的能力与视界”两个因素决定了地方立法研究动力与学术资源整合。研究会的学术平台应当有助于培养立法学教学科研与立法实务经验的良性互动的人员,如此才能提升地方立法研究动力与优化学术资源整合。要在全国范围内形成中国(法学会)立法学研究会—各省(自治区、直辖市)法学会立法学研究会联会—各省(自治区、直辖市)法学会立法学研究会层层递进、层层限缩式的格局来提升地方立法研究动力与优化学术资源整合,即通过“全国—省际—省内”三重范围有效实现研究立法学的助力和资源整合,最终为提升地方立法质量多提供一种选择与方法。
<<Nowadays,local legislative institutes have been established in succession in Beijing,Guangdong,Shanghai,Shanxi,Henan,Sichuan,Fujian,Shandong,Hebei,and Jiangsu. The motivation and integration of academic resources of the institute are decided by the factors that “whether a legislative research institute shall be established under the law society of each province (autonomous region or municipality directly under the central government)” and “the capability and vision of the chairman of the institute”. Therefore,the academic platform the institute shall be conductive to cultivate personnel that has benign interaction between the teaching and scientific research on legislation andthe practical legislative experiences,with a view to improving the motivation of local legislative research,and optimizing the integration of academic resources. To form such a progressive and narrowed legislative research structure on a national scale as “the China Institute of Legislation (China Law Society)-Joint Committee of Legislative Research Institute under the Law Society of each province (autonomous region or municipality directly under the central government) - Legislative Research Institute under the Law Society of each province (autonomous region or municipality directly under the government)” will improve the motivation of legislative research and optimize academic resources,namely,to integrate the support and resources of legislative research by “national-trans-provincial-inter-provincial” scale,and finally form an alternative to improve the quality of local legislation.
