服务贸易自由化采用“负面清单”管理模式,有利于分清政府与市场的边界,提高政策法规透明度,营造法治化、国际化、便利化的营商环境。然而目前中国在负面清单实施过程中仍在注册审批、知识产权保护、法律监管、信息流通、税收政策、市场自由度、金融环境、人才流动、文化融合和配套措施等多方面存在问题。为此,本文通过借鉴国内各自贸区相关政府管理的成功经验,采用案例分析的方法,提出四大方面的政府管理创新和八种具体的政府管理创新模式,尝试为负面清单实施过程中的政府管理创新提供一个较为完整的创新框架,并提出相应的改革建议。
<<Liberalization of trade in services using the“negative list”management mode,is conducive to distinguish between the government and the market,improve the transparency of policies and regulations,and create a ruled of law,international and convenient business environment. However,in the negative list implementation,registered approval,the protection of intellectual property rights,legal regulation,the circulation of information,tax policy,market freedom,financial environment,the flow of talent,cultural fusion,supporting measures and other aspects of problems still exist in the process.This paper,by referring to the successful experience of domestic free trade zone government management,using the method of case analysis,proposes four aspects of government management innovation and eight specific government management innovation modes,attempts to provide a relatively complete innovation framework for the implementation of the negative list of government management innovation,and puts forward the corresponding reform proposals.
