    北京市危害食品安全犯罪实证统计分析

    摘要

    食品安全是近年来一直受到社会关注的热点。笔者通过对北京市912份危害食品安全犯罪一审刑事判决书中1000名犯罪人员的实证统计分析,发现北京市的危害食品犯罪案件呈现逐年下降的趋势,犯罪行为多发生在中心区外围的城乡接合部地区,行为方式多以“销售”型为主,行为对象大多是保健食品,犯罪场所主要集中在保健品店、普通商店、药店和食品店等;犯罪人多为初犯,人身危险性较小,犯罪后果相对较轻。为此,相关部门应在治理方面加强食品安全知识普及,提高执法监管能力,加强“问题”食品的源头治理和强化重点人群的监管。

    Abstract

    Food safety has been the focus of public concern in recent years. Through the empirical statistical analysis of 1000 criminals in Beijing’s first criminal trial of 912 food safety crimes,found that hazardous food crimes in Beijing showed a declining trend year by year,crimes more occurred in the periphery of the central area of urban-rural areas,behavioral methods were more “sales” type,most of the behavioral objects were health food,criminal sites are mainly concentrated on health care stores,general stores,pharmacies and food shops. At the same time,criminals are mostly first-time criminals,with less personal danger and relatively minor criminal consequences. To this end,we should strengthen the popularization of food safety knowledge in governance,improve law enforcement and supervision capacity,strengthen the source control of the “problem” food and strengthen the supervision over key people.
