对于深层链接著作权侵权判定的司法标准，我国法院目前多数采取“服务器标准”。但“服务器标准”仅仅是在互联网发展的早期可以与互联网技术发展相适应的判断标准，在技术发展日新月异的当下，司法裁判必须实现与技术发展相对应。因此，与其被技术所裹挟而束缚手脚，不如抛开技术性判断标准，回归传统民法路径。以权利的本质属性为出发点，解释信息网络传播权的权利边界，并对照民事侵权行为的认定要件，合理认定深层链接行为的合法性边界。
<<When it comes to judgment of copyright infringement in deep links，the majority of the court tend to take the current server standards.But the adaptability of server standard is only in the earlier phase of development of the Internet，in the current，technology change rapidly，justice is not able to achieve the technology step.Instead of being coerced bound by technology，judgment standard can be put under traditional civil tort system regression.In the framework of the civil law，the right boundary of the right of information network dissemination is explained，and the legal boundary of the deep link behavior is reasonably determined according to the elements of the tort.
