新媒体环境下的参与文化、共享文化等催生了同人作品的繁荣。同人作品是指创作者借用小说、漫画、游戏、影视剧等作品中的人物名称、形象、性格设定、情节等元素进行二次创作、形成新的作品。同人作品创作过程中很容易与原作著作权产生冲突,其本身的著作权保护也存在着问题。本文以金庸诉作家江南著作权侵权案为例,探讨同人作品的著作权问题。笔者认为《此间的少年》属于非演绎类同人作品,并不侵犯原作的保护作品完整权和改编权等著作权,可以视为合理使用。新媒体环境下的同人作品,对繁荣文化市场很有价值,应从制度、第三方监督等方面共同促进同人作品著作权保护和避免侵犯著作权。
<<The participatory culture and shared culture in the new media environment have contributed to the prosperity of fanfiction works. The works of the fanfiction refer to new works that authors create based on characters,images,characters,plot in the original works of novels,comics,games,films,TV plays,and so on. There are copyright conflicts between fanfiction creation and original works and some problems in the protection of fanfiction works’ copyrights. This article takes Jin Yong v.Jiangnan’s copyright infringement case as an example to discuss the copyright issues of fanfiction. This article holds that the fanfiction named “There They Were” belongs to non deductive fanfiction works and does not infringe upon the copyright of the original works,such as the right of protection the integrity of the works and the right of adaptation and it can be regarded as fair use. Under the new media environment,fanfiction works are of great value to the prosperity of the cultural market. We should promote copyright protection and take the system and the supervision of the third party to avoid copyright infringement
