碳排放权交易体系(EmissionsTradingSystem,ETS)作为控制温室气体排放的一种市场手段,已经被多个国家或地区使用。我国计划在试点的基础上,于2017年启动全国统一ETS。本文分析了全国ETS设计的主要特点,并分析了这些特点形成的关键原因,识别了仍需要解决的关键问题和面临的挑战。全国ETS采用中央和省两级管理体系,既注重规则的统一性,又给予省级主管部门一定的自主权;主要采用了基于强度的总量目标,使用基于实际产量的基准线法来分配免费配额;纳入了间接排放,并以企业法人作为核算边界。目前全国ETS建设及运行中面临的问题和挑战主要包括:体系所依据规则的法律层级较低,监测、报告与核查(MRV)规则与基准线法分配对数据要求不协调、不一致等问题,与其他能源气候政策的有效协调对接机制还未制定。我国应尽快推进针对全国ETS的更高层级的立法,颁布具有可操作性的实施细则来指导配额分配、MRV、第三方核查机构资质管理、履约、交易等重要环节,协调好与金融行业监管和财政预算处理相关的规则,制定与其他能源气候政策的对接机制。
<<As a market-based instrument,the Emissions Trading System (ETS) has been used by multiple countries or regions. China plans to initiate its national unified ETS in 2017 on the basis of seven ETS pilots. This paper analyzes the main design features of the national ETS and its formation reasons,identifying key issues and challenges that still need to be addressed. The national ETS adopts the two-stage management system between the central and provincial government,which not only emphasizes the uniformity of the rules,but also gives the provincial authorities a certain degree of autonomy. The national ETS mainly uses the carbon intensity target,using the benchmarking method based on real production to allocate free allowances. The national ETS calculates the indirect emissions and chooses corporate legal persons as the accounting boundary. At present,the main problems and challenges in the construction and operation of national ETS include the low legal status of the rules,the inconsistency between the MRV requirements and the benchmarking allocation method,and the effective coordination mechanism of national ETS with other energy and climate policies has not yet been developed. Chinese government should promote advanced legislation for national ETS as soon as possible,promulgate operational rules to guide the allowance allocation,MRV,quality supervision on verification agencies,compliance,trading and other important elements,coordinate national ETS with the regulation of financial industry and government finance budget,and develop the coordination mechanism for ETS and other energy and climate policies.
