    浅论中国雾霾治理与法制建设

    摘要

    我国经济高速发展的过程中,粗放式的生产和管理方式遗留了大量环境污染问题,大面积、长时间的雾霾就是其中之一。我国已经初步建立起了雾霾治理的法律体系,对于空气质量恶化的控制和向好的改善发挥了决定性作用。随着工作的深入推进,进一步加强我国雾霾治理的法制建设是我国彻底实现空气质量管理目标的基本保障。本报告分别从立法、执法、司法和普法四个方面来看我国雾霾治理的法制建设,通过文献梳理和案例分析,讨论我国当前阶段雾霾治理过程中法制建设的发展现状和存在的有待改进的问题。得出结论认为我国未来雾霾治理的法制建设应在立法方面尽快出台相关法律细则;补充污染物治理种类;提高大气环境违法成本;理顺各级政府和企业环境治理权责关系。在执法方面:建立有能力、人数充足、装备精良的环境执法队伍;建立环境执法长效机制。在司法方面加强大气环境司法解释。在普法方面,加强公众参与的意识,并明确公众参与的途径和手段。

    Abstract

    In the process of rapid economic development in China,extensive production and management methods have left a lot of environmental pollution problems. The event of haze and smog,which is large area covering and long-time lasting,is one of them. China has initially established the legal system of haze and smog governance and control,which also has been playing a decisive role in the control of air quality deterioration and in the efforts for the improvement of the air quality. With the deepening of the work,further strengthening the legal construction of haze and smog governance and control is the basic guarantee for China to achieve the goal of air quality management. This article takes four aspects,from the legislation,the law enforcement,the judicature and the legal popularization,to look at China’s legal system construction of haze and smog governance and control. Through the literature review,this paper analyzes China’s legal system construction of haze and smog governance and control,including the present situation and the existence question. The conclusion is that the legal construction of the future governance and control of haze and smog in China should take consideration from the four aspects mentioned. In the aspect of legislation:the introduction of relevant laws and rules in details should be carried out as soon as possible;supplementary pollutant species should be include into a holistic system;increase the cost for breaking the environmental law and regulation;straighten out all levels of government and corporate environmental governance responsibilities. In the field of law enforcement,we should establish a contingent of environmental law enforcement teams with adequate capacity,adequate population and excellent equipment;and establish a long-term mechanism for environmental law enforcement. Strengthen judicial interpretation of the atmospheric environment in judicial matters. In popularizing law,we should strengthen the consciousness of public participation and make clear the ways and means for public participation.
