2016年,随着IANA域名职能管理权的移交,“该采用多边化模式还是多利益攸关方模式”的争论逐渐走向弥合,更多国家强调尊重各国平等参与全球网络空间治理权利,达成了应在尊重主权和不干涉他国内政原则基础上加强合作,构建和平、安全、开放、合作的网络空间治理新秩序的共识。同期,各国政府对于“网络主权”的诉求不断提升,各类主体之间的互动模式更加复杂,围绕网络空间治理相关议题的讨论走向深化,数据本土化、数据跨境流动及相关治理规则等议题成为各国政府的政策制定焦点。基于对年度重点事件的梳理和对相关文件、政策的分析,本文围绕“IANA职能管理权移交”和“跨境数据流动规则”两条主线对2016年全球网络空间治理发展态势进行了论述。
<<In 2016,with the process of IANA stewardship transition,the topic on “Multilateral vs. Multi-stakeholder” is moving beyond controversy,more countries declare that the right of each country to participate equally in Internet governance should all be respected,most of the countries reached a consensus that,to reform a peaceful,secure,open and cooperative order of cyberspace governance,they should strengthen cooperation under the premise of respecting others’ sovereignty and not interfering in others’ internal affairs. Meanwhile,the governments’ demands for “network sovereignty” are continuously increasing,the interaction patterns among government,private sector and civil society are further complicating,the discussions on cyberspace governance issues are unprecedentedly deepening,topics about “data localization”,“cross-border data flows” and related governance rules are becoming the main focus of governments’ policy making. Based on the analysis of annual events,documents and policies,this paper represented the current status and prospects of Internet governance worldwide following two plotlines:“IANA Stewardship Transition” and “Cross-border Data Flow Rules”.
