    转型期《未成年人保护法》刑责减免问题的社会学分析——以“四川青少年纵...

    摘要

    本文从“四川青少年纵火烧人案”为例追溯未成年人刑责减免的理念与制度的历史回溯、当代实践、困境及其化解之道。首先,自周代以降中国一贯采取“德主刑辅”的社会控制。其中,青少年刑罚减免原则便是周礼以教化为主刑罚为辅的表现。旧时代青少年虽可能减免国之罚,但不免予乡治之“礼法”。其次,当前中国处于转型背景下,一方面,基层空心化甚至暴力化导致价值失范;另一方面,青少年提前成熟的身体欲望未经规训而趋于泛滥甚至暴力化。若不顾教化缺失的实情而继续听任青少年免予处罚,无异于养虎为患。最后,化解之道在于,一方面,短时间宜“以刑止刑”;另一方面,长远看,从人性流品不齐与教化重建看,宜教与罚并行不悖,且差异对待,先教而后罚,加强感化以及学校人格教育等,不迷信教化万能,而当对不可教化者辅之以刑。

    Abstract

    Since Zhou-dynasty ethics has been reduced,the traditional Chinese has always taken “supplementing” social control characteristics. The juvenile penalty relief principle is the Duke of Zhou ritual contains the enlightenment to the main auxiliary performance penalty. In fact,the traditional agricultural era,although adolescents may cut in the national penalty,but the implementation of the heavy autonomous social base is both education and punishment function of “etiquette”:both education than before,or after the punishment. At present,China in rural society and the background of the transformation of the city gradually fading process,on the one hand,the hollow and even violence,premature abandonment of old traditional ethics has not established new lead to value anomie,on the other hand,young people early mature body desire without discipline and tend to flood even violence. If the lack of grass-roots education regardless of the truth,and continue to let young people from punishment,is tantamount to appeasement brings disaster. Therefore,to resolve the juvenile transgression lies,on the one hand,a short period of time,should be troubled with heavy penalties “and” reduction punishment with punishment",rather than in basic education lacking background for juvenile offenders from punishment. On the other hand,the long run,the uneven flow from the human nature and the ideal of education reconstruction should be taught,and punishment and the difference to run parallel,teach first and then fine,strengthen family influence and school personality education measures such as reconstruction of education system,not superstition and universal education supplemented by punishment.
