“互联网+”时代对个人数据的保护方式已成为世界范围内的热点问题,2014年欧盟27个成员国整体实施“被遗忘权”。本文关注该权利引发的隐私保护和言论自由之间的碰撞,以及欧盟与美国在该领域持的不同观点和立场。通过文献分析和对比研究阐述两者在“被遗忘权”上存在的争议。在对“谷歌西班牙诉西班牙数据保护局案”及英国《电讯报》的个案研究基础上,分析该权利在实践上的应用。本研究还探讨大数据背景下个人信息数字化后,新闻传播领域可能出现的情况以及应对之策,重点关注个人隐私与公众获知权之间的平衡。最后将“被遗忘权”放置在互联网与人的关系进化历程中探究其不可或缺的作用。
<<The way to protect personal data has becoming a worldwide hot topic in “internet+” age. Formally 27 EU member stated as a whole implementation of the “right to be forgotten” in 2014.This paper focuses on the rights caused by the collision between privacy and freedom of expression and the European Union and the United States in the field of different views and positions. Through literature analysis and comparative study to expatiate on the right of “forgotten” debate,in the “Google Spain v Spain Data Bureau” and the telegraph.cn.uk case studies based on the analysis of the application of this right in practice. At the same time discusses the background of big data after personal information digitization likely scenario in the field of journalism and communication and response,focus on the balance between personal privacy and the public right of inform. The last is discussing the right of “forgotten” on the internet and people’s relationship to emphasize its indispensable role in evolution.
