自2012年四川省检察机关和政府法制机构共同开展行政执法与刑事司法衔接(以下简称“两法衔接”)工作以来,四川省“两法衔接”工作取得了重大进展。但是,因为缺乏明确、系统的法律依据,导致“两法衔接”工作出现了责任单位不明确、法定职责不清晰、案件移送和处理机制不畅通、信息共享平台运用和管理亟待加强等问题。省检察院开展专题调研,全面梳理四川省“两法衔接”工作发展及现状,深入分析开展“两法衔接”地方立法的必要性和可行性,并就立法内容提出了若干意见和建议,以期推进地方立法工作,确保“两法衔接”有法可依。
<<Since 2012,the procuratorial organs and government legal affairs offices in Sichuan Province have jointly carried out the coordination between administrative law enforcement and criminal justice(hereafter referred to as “the coordination work”)and achieved major results in this respect. However,because of the lack of a clear and systematic legal basis,many problems have emerged from the coordination work,including the uncertainty of organs in charge of the work,the ambiguity of legal responsibilities,the defective case transfer and handling mechanisms,and insufficient application and weak management of information sharing platform. In view of these problems,the People’s Procuratorate of Sichuan Province has carried out special investigation on the development and current situation of the coordination work in the province,analyzed the necessity and feasibility of carrying out local legislation on the coordination work,and put forward opinions and suggestions on the content of the legislation,with a view to promoting local legislative work and ensuring that the coordination work is carried out in accordance with law.
