2016年中国自贸区法制建设稳步推进,成效显著。上海自贸区继续发挥引领作用,在预定的三年试验期内完成了先行先试和积累可复制可推广经验的任务,带动自贸区建设多点开花。广东、天津、福建三个自贸区条例的颁布施行,使得自贸区建设更加于法有据、有章可循;条例中“服务京津冀协调发展”“粤港澳合作和‘一带一路’建设”“闽台交流与合作”等专章的设置,有助于各个自贸区在共性与个性之间找到更好的平衡。下一步应当考虑制定全国性的“自由贸易园区条例”乃至“自由贸易园区法”。
<<In 2016,China has made steady progresses and remarked achievements in the construction of the legal system of free trade zones. Shanghai had continued to play the leading role in this respect by successfully completing the tasks of carrying out experimentations and accumulating replicable experiences within the scheduled three-year pilot period;the promulgation and implementation of regulations on free trade zones by Guangdong Province,Tianjin City and Fujian Province had provided legal basis for the construction of free trade zones;The special chapters on “Servicing the Coordinated Development of Beijing-Tianjin-Hebei Region”,“Guangdong-Hong Kong-Macao Cooperation and Construction of ‘One Belt and One Road’”,and “Communication and Cooperation between Fujian and Taiwan” in these regulations are conducive to striking a balance between the “commonalities” of all free trade zones and the “particularities” of each free trade zone. At the next stage,China should consider adopting national Regulations on Free Trade Zones,even a Law on Free Trade Zones.
