经济新常态下,我国就业表现稳中有进,这得益于创业带动就业。“第四次创业浪潮”中的大众创业强调以网络为依托,“互联网+”传统产业模式,一方面,通过新业态和互联网平台的创立,加速传统产业的升级,新增了就业岗位;另一方面,通过对传统产业的渗透,带来就业形式的灵活化、就业时间的弹性化、雇佣关系的多样化,进而对传统劳动关系协调机制形成挑战。诸如滴滴打车、优步(Uber)等带来更多工作岗位和兼职机会,然而,在实际工作中,创业企业却无法为这种非正规就业状态下的劳动者提供安全的用工保障。同时,在国家法律和工会政策方面,也缺乏有利于用工企业、中介平台以及劳动者三方的利益的法律和机制保障。以《劳动合同法》为基础的传统劳动关系,和以集体协商机制为重点的法治推进,均难以有效管理互联网时代复杂多样、自由松散的劳动关系,为完善劳动关系协调机制提出新的挑战。
<<New normal economic period,China’s employment stability,the number has increased,because entrepreneurship to create jobs.In the “fourth wave of entrepreneurship”,people to do business creatively using the Internet technology,“Internet +” traditional industry model brings two effects:On the one hand,Employment Effect,the enterprise create new business formats and Internet platforms to accelerate the upgrading of traditional industries,added jobs. On the other hand,Internet technology penetration of traditional industries,bringing diverse and flexible forms of employment,resilient time employment,the employment relationship,and challenge the traditional labor relations coordination mechanism.Such as Car-hailing apps(Didi and Uber) bring more jobs and opportunities for part-time. However,in practice,Car-hailing apps can’t provide employment security safeguards for the Non-standard employment.Meanwhile,China’s legal system of labor lack of legal mechanisms to protect the Non-standard employment and Internet employment.Traditional labor relations and coordination mechanism is difficult to effectively manage complex and diverse,freedom and flexibility labor relations. These presents us with new challenges to improve the coordination mechanism of labor relations.
