长期以来,信访承担着权利救济功能,并且其受理范围未区分不同的矛盾纠纷类型。随着信访法治化的逐渐推进,信访范围的不确定性和模糊性已经不适应法治化和矛盾纠纷化解的需要。明确信访受理的范围,需要对不同的矛盾纠纷进行识别,排除应由其他方式解决的纠纷,并确立“正三角”结构的行政纠纷解决模式。同时,完善整体配套制度,如分类识别、诉访分离、案件终结、信息共享等,推进信访矛盾纠纷的化解。
<<For a long time,one of the petition letters’ functions is relief rights,and there are different types of disputes. With the development of petition letters,the uncertainty and fuzziness of accept range in petition letters don’t resolve the conflict effectively. So it is necessary to certain the range,distinguish the disputes,remove the disputes which should be resolved by other systems,and establish the appropriate model in resolving administrative dispute. Meanwhile,it is important to improve the whole systems,such as classification and distinguish of disputes,separating petition letters from litigation,ending of cases,information sharing. It is helpful to resolve the social conflict and dispute.
