河南作为第三批司法改革试点地区,相关的改革工作正在部署中。河南法官检察官职业准入和选任制度与全国一样,存在双考中“劣币”驱逐“良币”、扎堆报考、年龄限制不合理、选任方式行政化等问题。建议在改革中要学习国外先进制度和吸取改革先行试点地区的成功经验,特别关注制度理念现代化、司法队伍精英化、任职回避严格化、绩效考核多元化、选任机构专门化、退出惩戒规范化、任前公示实效化和职业流动常态化等方面的制度建构。
