本论文是香港职业健康及安全政策体系的探索性研究,目的是了解香港职业健康及安全政策体系的历史推动力、依附轨迹和政策结果。本研究以Pempel(1998)的国家体系理论和Esping-Andersen(1990)及Gough(1999)的福利体系理论架构为基础,采取历史回顾性的单一个案(潜嵌)设计,对1947~1997年的香港职业健康及安全政策体系整全个案和建造业健康及安全政策体系潜嵌单位进行全面、深入和多面向的探究。本研究发现香港分散及力量薄弱的工人阶级集体力量、信奉新自由主义而力量强大的金融资本与殖民地政府结合的管治联盟、行政主导及有限民主的政治制度、积极不干预的经济政策及低度发展的劳工和社会福利制度及全球化经济等因素的互动情况下,催生了香港新自由职业健康及安全的政策体系。本论文的实证研究显示香港的职业健康及安全政策体系接近新自由主义的原型。香港新自由职业(包括建造业)健康及安全政策体系是会穏定发展的。当香港面对外在和内在的政治、经济和社会压力时,其政策体系的响应方式始终不偏离新自由主义的依附轨迹,有的只是政策范式的变化而没有出现范式的转移。本研究亦发现新自由职业健康及安全政策体系依附轨迹运作的结果,是低度发展的福利和严重的职业伤病意外和死亡。这些结果分化了社会阶层和巩固了香港管治联盟的权力基础,从而反过来巩固新自由主义职业健康及安全政策体系。本研究也发现新自由职业健康及安全政策体系的实践是多元的。虽然属于同一体系,不同国家在特定的历史时空和不同的政治、经济和社会背景下有不同的实践。香港属于低度介入及自愿性自我规管类型。最后,本论文对改善香港职业健康及安全政策和未来研究领域提出了一系列的建议。

This paper is an exploratory study on the occupational health and safety policy system in Hong Kong. The purpose of this study is to understand the historical driving force, dependent trajectory and policy results of the occupational health and safety policy system in Hong Kong. Based on the national system theory of pempel (1998) and the welfare system theoretical framework of esping Andersen (1990) and Gough (1999), this study adopts a historical retrospective single case (latent) design to conduct a comprehensive, in-depth and multi-faceted study on the whole case of Hong Kong's occupational health and safety policy system and the hidden units of the construction industry health and safety policy system from 1947 to 1997 explore. This study finds that Hong Kong was born out of the interaction between the scattered and weak working class collective power, the powerful financial capital believing in Neo liberalism and the colonial government, the political system dominated by administration and limited democracy, the active non intervention economic policy, the low development of labor and social welfare system and the globalized economy New policy system of occupational health and safety. The empirical study of this paper shows that the occupational health and safety policy system in Hong Kong is close to the prototype of Neo liberalism. The health and safety policy system of Hong Kong's new self employment (including the construction industry) will develop steadily. When Hong Kong is faced with external and internal political, economic and social pressures, the response mode of its policy system always does not deviate from the path of Neo liberalism, some of which are just the changes of policy paradigms without the shift of paradigms. This study also found that the results of the operation of the new occupational health and safety policy system are low-level welfare development and serious occupational injuries and deaths. These results have divided the social strata and consolidated the power base of the Hong Kong governance alliance, which in turn consolidated the neoliberal occupational health and safety policy system. This study also found that the practice of the new policy system of occupational health and safety is diversified. Although they belong to the same system, different countries have different practices in specific historical space-time and different political, economic and social backgrounds. Self regulation and self-regulation belong to the type of low regulation in Hong Kong. Finally, this paper puts forward a series of suggestions for the improvement of occupational health and safety policy and future research fields in Hong Kong.
