作为实现农地规模经营或农村集体土地流转的常见方式之一,农村土地股份制对繁荣农村集体经济、增加农民收入具有积极作用。囿于既往的实践与现实制度等问题,目前有关农村土地股份制的理论研究仍呈现众说纷纭但共识微乎其微的状态,未能形成对实践探索的有效指导。以现代股份制理论为逻辑起点的相关概念辨析发现,我国农村土地股份制是股份制与农村土地产权制度深度融合后的新型农村土地经济制度体系,是以土地(地类、权利和权能等)股份的配置、经营、收益与管理为核心,以股权配置(股东资格界定、股权设置、股权量化)与流转、经营与收益分配及土地股份经济组织运行管理等为构成要素的制度体系。我国粤、浙、苏、京、沪、川等省市既有的各种以所谓“农村土地股份制”名义存在的实践探索分别需要进行有效规制和完善,以推进农村土地股份制的规范和可持续发展。
<<As one of the most popular ways to realize agricultural scale management or rural collective land circulation,rural land joint-stock system has played a positive role to the prosperity of rural collective economy and increase the income of the farmers.Limited by the issues as the past practice and reality system,the current theoretical research about rural land joint-stock still presents a state that diversified public opinions share little common consensus and fail to form the effective guidance to the practical exploration. Based on the modern stock theory as the logical starting point of related concepts analysis,China’s rural land joint-stock system is a new type of rural land economic system focusing on the deep fusion of shareholding system and the rural land property rights system,which is a system with the land(land types,rights,functions and so on)stock configuration,operation,revenue and management as the core,with the ownership allocation(the definition of share qualification,equity setting,quantification of the stock)and circulation,management and distribution of income,the operation and management of land joint-stock economy organization as composed elements. The practice and exploration of various existing under the name of so-called “rural land joint-stock” in Guangdong,Zhejiang,Jiangsu,Beijing,Shanghai,Sichuan and other regions of China,effective regulations and targeted improvements should be addressed in order to promote the specification and sustainable development of rural land joint-stock system.
