残疾人就业保障金制度本为促进残疾人就业设立,近年来却因资金运作不透明等问题备受争议。笔者采取文献研究与调查研究相结合的方式,在对残保金制度历史背景及运行机制进行梳理的基础上,分析制度实施带给各利益相关方的影响,研究发现该制度的实施效果已背离其设立初衷。残保金制度并未改善残疾人就业局面,却成为一些用人单位尤其是政府部门拒绝招用残疾人的“挡箭牌”。在“重收钱轻就业”的制度导向下,残保金的连年大幅增收给企业和社会造成较重经济负担,却为残联等部门带来巨大既得利益。笔者认为,这些情况的出现与制度设计实施中公众参与不充分密切相关。为此,笔者对相关议题倡导者提出行动建议。
<<The Employment Security Fund for Persons with Disabilities is a national mechanism set up to promote employment for persons with disabilities. In recent years,this Fund has been challenged frequently because its usage has stayed unclear to the public. This essay,through an analysis of existing literature and a few investigations of practice,finds that the mechanism has strayed away from its original purpose,in the sense that the employment of persons with disabilities has barely benefited from the Fund. Instead,due to the existence of this Fund,some employers,especially those from the public sector,have been offered a legitimate excuse for not hiring any person with disabilities. As the Fund requires employers to pay a certain amount of fine if they fail to meet the quota,i.e. 1.5% of their employees being persons with disabilities,enterprises are placed under an ever-increasing financial burden,while the governmental arms,such as the CDPF (China Disabled Person’s Federation),are receiving large amount of money which is distributed in a non-transparent way. Based on the above research,the essay finds that insufficient participation of persons with disabilities in the policy-making process is a key factor for the mechanism’s deviation from its purpose,and proposes several advocacy strategies for activists in this field.
