2014年4月,《环境保护法》修正案获得通过,因规定了“按日计罚”“查封扣押”“违法行政拘留”以及强化信息公开和公众参与,明确了环境公益诉讼主体资格等亮点而被称为“史上最严”的环保法。然而展望这部法律的实施前景,应该说并不乐观。现实法律环境下“执法不严”“违法不究”的沉疴以及多种因素形成的环保执法队伍“不会查”“不能查”“不作为”“乱作为”等突出问题,短时间内恐难改变。有关部门对新《环境保护法》的执行力能否得到有效加强面临着严峻考验。《大气污染防治法》在争议声中完成修订草案,并提交全国人大常委会审议;《土壤污染防治法》《核安全法》仍在制定中。
<<The new Environmental Protection Law was passed in April 2014. It has been referred as “the strictest environmental protection law ever” because it includes provisions concerning penalties calculated on a daily basis,sequestration,administrative detention,enhanced information disclosure and public engagement,and clarified requirements for parties to file environmental public interest litigation. Despite these advancements,we are not necessarily optimistic about the prospects of this law after it goes into effect. In reality,it is difficult to rapidly solve persistent problems such as loose enforcement and impunity and to confront severe problems with environmental law enforcement officials,including lack of expertise,inability to investigate,inaction and unnecessary action. The effective implementation of the new Environmental Protection Law faces many tough challenges.
Meanwhile,despite some controversy,draft amendments to China’s Air Pollution Prevention and Control Law have been completed and submitted to the Standing Committee of the National People’s Congress(NPC)for review. China’s Soil Pollution Prevention and Control Law and the Nuclear Safety Law are still being drafted.
