调解在劳动争议处理中具有基础性作用。本研究从调解风格、调解原则、调解实施主体、调解员、调解方法等方面总结了我国劳动争议调解方法和技巧的特点。在此基础上,将调解过程分为调解准备、调解员开场、当事人阐述、解决问题和协议阶段五个阶段,本文以其中的调解准备阶段为例对分阶段的调解方法和技巧进行了介绍。作为一项应用型研究,本研究成果将以调解员培训材料的方式进行转化应用。
<<Mediation has a fundamental role in the labor dispute process. This research summarized the characteristics of the labor dispute mediation methods and skills in China,in terms of the mediation style,mediation organization,mediator,and mediation method,etc. And on this basis,the mediation process is divided into five stages:mediation preparation,the mediator opening,the parties elaborated,problem solving and negotiation phase. Take the mediation preparation phase for example,this paper introduced the specific methods and skills of every mediation stages. As an application-oriented research,results of this study will be applied in the mediator training program.
