随着2008年《劳动合同法》等一系列劳动法律法规的实施,以此为基础的劳动关系发生了巨大变化。本研究基于全国总工会2007年、2012年对8万多名员工的调查数据,采用独立样本比例差异检验分析了《劳动合同法》实施前后不同年龄、文化程度、户籍身份与就业身份的职工群体在各项劳动权益保障上的差异。结果显示劳动法律制度的重大变革对不同职工群体产生了差异化的影响。劳动合同法实施后,处于相对弱势的年长、大专以下文化程度的职工、农民工与普通职工群体在多数劳动权益保障上同样处于显著劣势。
<<With the implementation of 2008 Labor Contract Law and a series of related labor regulations,Chinese labor relations have experienced drastic transformation among different groups. Drawing on national survey data of more than 80000 workers conducted by All-China Federation of Trade Union(ACFTU)in 2007 and 2012 respectively,this article uses independent sample proportion difference test to investigate the differences of lab labor or rights security among worker groups from different ages,educational levels,household registrations and employment statuses. The result reveals that the transformation of labor legal system makes diversified effect on worker groups. Since the Labor Contract Law comes into effect,the protection of most labor rights of worker groups in older age,low educational level,migrant workers and ordinary workers are still in significant disadvantage.
