Currently the main problem of the requisition of urban housing on state-owned land is the weak enforcement of the applicable laws. The law applicable to the requisition of collectively-owned land is lacking and therefore China should adopt as soon as possible the Regulations on the Requisition of Collectively-owned Land. The legal nature of the requisition of urban housing is the same as that of the requisition of collectively-owned rural land. A unified law on the requisition of real estate should be adopted when conditions permit. To truly solve the problems in the requisition of real estate, China must straighten out the relevant chains of interest and construct a more rational central-local government relationship.
