统筹城乡土地改革和制度建设主要体现在三个方面。一是赋予农民更加充分而有保障的土地承包经营权;二是改革集体建设用地使用制度,建立城乡统一的建设用地市场;三是改革征地制度,建立符合市场经济要求的土地征收公正补偿机制。具体说,进一步延长土地承包经营权的期限,平等保护农民享有的土地承包经营权,在尊重农民的主体地位的前提下,鼓励农民依法自愿有偿地流转土地;稳步开放农村集体建设用地流转市场,改革和完善城乡统一的建设用地使用权制度、城乡一体的建设用地市场监管体系、城乡统一的建设用地流转收益分配体系和农村集体建设用地供应和取得制度;同时,改革、完善对国有土地和集体土地实行同地、同权、同价的公正补偿办法,逐步缩小征地范围,完善征地程序。
<<With a view to providing farmers with more adequate and secure right of land contracted management,we must further extend the period of the right of land contracted management,protect the right of land contracted management entitled to farmers impartially and encourage them to lawfully and willingly trade land at a reasonable price while recognizing farmers’ status as a right holder.Collective construction land which enters the market with license should be uniformly under the land use right administration.After entering the market,collective ownership of collective construction land may be retained.By reform,the use right of collective construction land should be classified into allocated land use right and granted land use right of collective land,which correspond to the allocated land use right and granted land use right of state land.We should establish a uniform system for urban and rural allocated land use right and granted land use right,and unify the urban and rural construction land market on the basis of a uniform granted land use right.The land system should be reformed so that a justified compensation mechanism for land expropriation can be established and meet the requirements of the market economy.Specifically speaking,through reforms,the same right and price should apply to state-owned land and collectively-owned land of the same kind in compensation for expropriation,the scope of expropriation should be reduced gradually and the procdures for land appropriation should be improved.
