传统医患纠纷化解陷入了“私了”没法了、“官了”了不了的尴尬局面,导致医患纠纷持续增加。2005~2007年,遂宁市年均发生医患纠纷超400起,其中医闹事件超300起,严重影响社会的和谐稳定。对此,遂宁市选择引入第三方调解机制,坚持树立法治思维、运用法治方式化解医患纠纷,取得了有效突破。本文从遂宁市依法化解医患纠纷的法治导向确立、法治架构搭建、保障机制设计、法治效应显现进行实证分析,探索医患纠纷化解的有效途径和长效机制。
<<Today,traditional doctor-patient disputes are in an awkward situation in which it is very difficult for them to be settled either outside or inside court. As a result,the number of such disputes has been increasing steadily in the past years. Between 2005 and 2007,there had been over 400 doctor-patient disputes,including over 300 disputes involving third parties who used doctor-patient disputes to created disturbance in hospital and illegally profit from it,each year. These disputes had seriously affected social harmony and stability. In light of this situation,the Government of Suining City introduced a third party mediation mechanism,adhered to the rule-of-law approach,used rule-of-law methods to resolve doctor-patient disputes,and achieved effective breakthroughs. This report carries out empirical analysis of the practice of Suining City in resolving doctor-patient disputes in accordance with law from the perspectives of the choice of the rule-of-law orientation,the construction the rule-of-law framework,the design of safeguarding mechanisms,and the manifestation of the effect of the rule of law,and explores effective approaches to and long-term mechanisms for the resolution of doctor-patient disputes.
