    论中国司法管理体制改革的切入点

    摘要

    本文通过分析司法活动的性质和特点,对一个国家的司法体制做了两个角度的划分,指出一个国家的司法体制是由司法组织管理体制和司法运行体制构成的。司法管理体制主要解决的是司法机关如何设置以及如何配置司法权力;司法运行体制主要涉及司法机关运用司法权力解决具体案件的法律程序和法律机制。司法管理体制是国家司法权力配置、组织和运行的机制和制度,其中司法机关的法律性质和法律地位如何确定、上下级司法机关之间的相互关系、司法人员如何产生和履行职务、司法职权如何设定和配置、司法功能如何得到充分和有效发挥等,是司法管理体制的重要制度内涵。司法管理体制在一个国家的司法体制中具有基础性的建构作用,有什么样的司法管理体制,就有什么样的司法运行体制;司法运行体制运转不畅,主要来源于司法管理体制的设计缺陷。本文通过分析我国司法政策的演变,认为司法管理体制改革在我国当下的合法性依据来源于司法政策,特别是党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》(以下简称《决定》),对司法体制改革,特别是司法管理体制改革提出了明确的要求。笔者认为,要正确地贯彻落实《决定》的要求,应当将司法活动通过宪法修改纳入国家基本制度范畴,依托人民代表大会制度的基本制度框架,建构由全国人大常委会作为最高司法机关的“大司法”管理体制,同时还要正确处理党委政法委与法院、检察院和公安机关之间的关系,协调公、检、法、司在刑事案件审理中的相互监督和制约关系,健全司法队伍,推进法官、检察官和警官的职业化,并尝试建立与行政管辖区适当分离的审判制度,进一步保证司法机关依法独立行使司法职权,维护司法正义。

    Abstract

    Based on the analysis of the nature and characteristics of judicial activities,this article divides the judicial system of a state into two parts:judicial organization and administration system and judicial operation system. The former is mainly responsible for the organizational structure of judicial organs and the allocation of judicial power whereas the latter mainly consists of legal procedures and mechanisms by which judicial organs exercise their judicial power to deal with concrete cases. Judicial administration system consists of mechanisms and institutions for the allocation,organization and operation of state judicial power. Its main institutional contents include the nature and legal status of judicial organs,the relationship between judicial organs at different levels,the appointment of and performance of functions by judicial personnel,the allocation of judicial functions and powers,and mechanisms aimed at bringing judicial functions into full and effective play. Judicial administration system plays a fundamental role in the construction of judicial system in a country:judicial operation system is determined by judicial administration system. Defections in the design of judicial administration system are the main causes of the malfunction of the judicial operation system. This article analyzes the development of judicial policy in China and maintains that currently the legitimacy of the reform of judicial administration system in China comes from judicial policy,especially the Decision on Several Issues Relating to Comprehensively Deepening the Reform (the Decision),adopted at the Third Plenary Session of the CPC Central Committee. The Decision raises specific demands on the reform of the judicial system,especially the judicial administration system. The author of this article is of the opinion that,in order to correctly implement the Decision,the government should amend the Constitution so as to incorporate judicial activities into the scope of basic state system and,on the basis of the basic institutional framework of the system of people’s congresses,construct a judicial administration system with the Standing Committee of the National People’s Congress as the highest judicial organ,correctly deal with the relationships between political and legal affairs commissions,courts,procuratorates and public security organs,coordinate the relationship of check and balance between public security organs,procuratorates,courts and judicial administration organs in the handing of criminal cases,improve the quality of judicial personnel,promote the professionalism of judges,prosecutors and police officers,establish a trial system separated from the system of administrative precincts,and further ensure the independent exercise of judicial functions and powers by judicial organs,so as to uphold judicial justice.
