China has entered an aging society，and the elderly crime is increasing，which should not be ignored. Because of the physical，psychological reasons，along with the growth of the age，capacity of criminal responsibility will be gradually reduced and eventually lost. The penalty may lose the significance of transforming to some very old criminal，for the age and health. However，the elderly may re-crime，so according to the criminal policy of combining punishment with leniency，community correction to the elderly is possible and feasible. But community correction should focus on personal status of elderly criminal. Community correction should object to the elderly who first offended on restorative justice，respect for the wishes，the psychological treatment，participating in public welfare labor，and social services.
