在美国多重的社会治理手段中,替代性纠纷解决机制(ADR)十分重要。美国的非营利组织发挥着ADR的实践者、倡导者、研究者、交流平台、资助人、教育者和国际合作促进者的作用,与政府一道努力,在总人口快速增长、社会财富分配不公的条件下,化解了大量社会矛盾。非营利组织深度和全面介入替代性纠纷解决机制的原因,可以从美国历史文化遗产、近40年来美国社会与司法制度的变化、非营利部门的壮大以及各级政府的支持中去寻找。美国的经验对于面临社会治理挑战的中国不失借鉴意义。
<<Alternative Dispute Resolution (ADR) is,among many public governance tools,a very important one in the United States. The nonprofit sector is playing multi-roles as ADR’s practitioner,promoter,researcher,professional association and exchange platform,funder,educator,and international co-operator. American nonprofits and the government agencies have been working together to resolve numerous civil disputes and conflicts in the society resulted from a fast increase of population and institutionalized wealth inequality since 1970s. The main reasons behind such a deep and comprehensive involvement in ADR can be traced back to the American historical and cultural heritage,the changes in American society and civil justice reform,the rapid growth of nonprofit sector and governmental supports to ADR. American experience as well as its lessons in ADR is valuable reference for China,which is now confronting huge challenges in social governance.
