集体协商制度是市场经济国家调整劳动关系、解决劳资冲突的核心制度。我国的集体协商制度自建立以来,经过政府的高度重视与强力推动,得到了快速发展。然而,我国在集体协商制度的立法方面仍存在立法层次低、主体权利义务关系不明确、缺乏行动保障等问题。因此,为了完善我国的集体协商制度,需保障劳工“三权”,巩固集体协商制度运行的基础;建立健全利益争议的处理机制;重塑政府在集体协商工作中的角色,以实现我国劳动关系的和谐稳定发展。
<<The collective negotiation system is the core system for adjusting labor relations and settling employee-employer disputes in market economy countries. As of its establishment,the China’s collective consultation system has developed rapidly depending on high attention and vigorous promotion of the government. However,in the legislation for it,there are the problems of low legislation level,unclear right-obligation relationship and absence of assurance with action. Given this,in order to perfect the China’s collective consultation system thus realize harmonious and stable development of labor relation in China,it is necessary to protect the “3 rights of laborer”,firm the foundation for the system,establish and perfect the mechanism for settling interest disputes,and re-build the role and position of the government in collective consultation.
