20世纪90年代,我国引入了美国的保险营销员制度。在美国,该制度构建的营销员与保险公司之间的关系为委托代理关系。但是,这种关系在我国发生了变异,出现了委托代理关系、事实劳动关系以及承揽关系三种学说。笔者分析了这三种学说,认为我国现行制度构建的是一种兼有事实劳动关系与委托代理关系的混合制。由于具有事实劳动关系性质,在《中华人民共和国劳动合同法》实施之后,法官对此种关系的认定可能对保险公司不利。为了改变这种不利因素,应当以法律形式确认混合关系,或者着眼长远,在我国建立职员制的营销员制度。
<<China inducts American system of insurance agent in 1990’s.In America,the relationship between insurance agent and insurance company was known as principal-agent relationship,but this relationship in China had been changed.The relationship between insurance agent and insurance company in China includes three theories:principal-agent relationship,labor relationship in fact,and work contract relationship.author analyses all three theories,and protests that Chinese actual system includes Principal-agent relationship and labor relationship in fact.Because this system includes labor relationship in fact,so,after the law of labor contract putting in practice,result will be disadvantageous to insurance company.For changing this disadvantage,law should affirms this mixed relationship,or establishes labor relationship between insurance agent and insurance company.
