    乳业食品安全的政府规制和市场契约研究

    摘要

    本文认为,乳品质量安全信息的不对称和外部性,决定了政府进行规制和公共干预的必要性。中央政府的规制措施主要职责在于建立、健全乳品质量安全的法律法规、质量标准体系、检测检验体系和质量管理与认证体系;地方政府对乳品质量安全的规制和管理主要体现在执行中央政府制定的乳品质量安全法律、法规和制度、标准,制定地方性的法律法规,监管乳品生产企业的乳品质量安全行为。乳品供应链的各个主体之间需要有完善的契约来清晰界定质量安全的责任,并要建立良好的机制来保证契约的有效执行,最终保障乳品的质量安全。可供选择的政策有:发展规模饲养、完善乳品质量安全的相关契约、发展牛奶生产者的联合、加快乳业质量安全监测检测技术、缔造竞争环境、为乳品交易各方提供质量安全监测服务、加快质量安全纪录和追溯体系建设、积极推行标准化养殖方式、成立独立的第三方认证机构、提高对地方政府与当地乳品企业串谋的经济和非经济处罚力度;提高乳品质量安全监管的行政效率;提高地方政府对假冒高质乳品的乳品生产商的罚金。

    Abstract

    Because of the information asymmetry and externality of quality and safety of dairy products,regulating of government is indispensable. Regulating of central government basically should concentrates on the establishment and improvement of law and rule system,quality and safety standard system,monitoring and examining system,safety management system and authorization system concerning dairy product quality and safety;local governments regulation should focus on the implementation of law,rule,standard and policy of centre government,formulation of local law and rule concerning food safety;monitoring the dairy product safety behavior of enterprises. The quality and safety responsibilities of every subject on the dairy product supply chain need to be clearly defined by contracts and implemented efficiently with a proper mechanism so as to realize quality and safety of dairy products. The policy suggestions are:promoting the development of large scale dairy farm;perfecting contract of dairy product quality and safety;developing dairy farmer unions;promoting the monitoring and examining technology progress;creating the competing environment,supporting third-party examining service;extension of dairy farming modules,establishing documentation and traceability system;intensifying the economical and non economical punishment to the cahoots between enterprises and local governments;improving the efficiency of dairy product quality and safety administrations;increasing the punishment to the enterprise which counterfeits high quality and safety dairy products with low ones.
