广州于2008年展开的城管体制改革引起了各界的广泛关注。此次变革的一些讨论既反映社会公众对于城管的总体认知和态度,也反映出政府作出这项变革的动力和决心。在这样的背景下,本文试图通过广州城市管理综合执法情况的调研,探讨多元委托关系中城管所面临的困局。本文指出,城市管理中的委托代理关系是多层级、多目标的,公众、政府、城管(政府体系末梢)形成层层委托代理的关系。在这种多元委托代理关系下,城管往往被上游代理人“抛弃”,导致公众对城管产生不信任感甚至形成污名化的社会形象。与此同时,城市社会经济快速发展所引发的社会问题通过委托代理关系,转嫁到城管身上。文章在最后提出用“服务”代替“执法”转变城管的管理理念,突破当前我国社会转型时期城管治理的困局,借以更好地实现建设“和谐社会”的宏伟目标。
<<The Urban Management Reform of Guangzhou launched in 2008 have drawn extensive attention.Some discussion of this change reflects not only the public version of the urban management,but also the motivation and determination of Government in making this change.In the context of the above,this paper attempts to explore the dilemma faced by urban management in the relationship between pluralistic principal-agent relationships through a comprehensive survey on the law enforcement situation of Urban Management of Guangzhou.This paper points out the multi-level and multi-objective relations between principals and agents in urban management.The public,government and urban management form the multilayer of principal-agent relationship.In such a multi-principal-agent relationship under which the upstream agents will often abandon the urban management,causing the public distrust and the public stigma of urban management.With rapid economic development,a large number of social problems along have been transferred to the urban management by principal-agent relationships.Finally,this article proposes to change the management philosophy of urban management with the “service” instead of “law enforcement”,solving the dilemma of urban management in the transformation period,in order to achieve the goal of “harmonious society”.
