“法治”是一个开放的概念,有着丰富的内涵,而社会管理是随着社会的发展和人们法律意识的不断增强、法治实践经验的不断丰富,而“与时俱进”地发展变化。两者之间存在相辅相成、相互制约、相互包含的逻辑关系。当前社会管理存在职能的迟缓性、权威的弱化性、手段的滞后性、利益的局限性等突出问题。要形成一种长效的社会管理模式,就必须实现社会管理的法治化,即社会管理的主体以法治理念为基点、社会管理的措施以法治手段为依据、社会管理的职能以法治原则为界限、社会管理的过程以法治程序为始终、社会管理的责任以法治监督为保障、社会管理的成效以法治价值为评估。
<<The rule of law is an open concept with a rich connotation whereas social management evolves with the development of society,the continuous enhancement of people’s legal consciousness and the enrichment of people’s experience of the rule of law. The two form a logical relationship of being supplementary to each other,checking and balancing each other,and encompassing each other. Currently the most prominent problems in social management include the tardiness in the performance of functions,the weakening of authority,the backwardness of methods,and the localization of interest. In order to development an effective and lasting social management mode,it is necessary to bring social management into the orbit of the rule of law. Namely,subjects of social management must take the idea of the rule of law as their base point,measures of social management must take legal methods as its basis,functions of social management must take legal principles as their boundary,processes of social management must take legal procedures as their starting and end points,responsibilities of social management must take legal supervision as the safeguards,and assessment of social management must take legal values as its criteria.
