本文探讨的是在一个民主法治国家的框架下,应该以何种方式去理解刑事正义。在一个民主法治国家中,对刑事正义的全部构想应当认识到以个人为中心的一些特定观念。尽管一个罪犯必须被看作社会的一员,且该社会的法律定义了罪犯,但是某些人对规则的违反并不能够将罪犯排除在社会之外,或使得简单的工具主义方法获得正当性。在一个民主法治国家中,刑法和刑事正义的角色总体上应当被最小化。刑事正义的伦理学致力于非功利性问题,什么是区分法律上是与非的好规则,以及在不得已的情况下何种行为构成犯罪。这些问题的研究将建立在互相承认和尊重的基础上,将渗透刑事正义的各个层次,这也是一个好的政体的标志。刑事正义的伦理学既保留刑事正义中的道德成分又不致陷于道德主义。它将人作为社会成员来处理,但同时将行动的法律责任和道德责任保留给个人。
<<In this article the author discusses the way in which one should understand criminal justice in the context of a democratic Rechtsstaat. The point is that in a democratic Rechtsstaat the entire thinking about criminal justice should be informed about certain specific view which sets the individual into the center. Even the offender must be seen as a member of the same community from which the law so defining originates,Breach of the rules by someone does not justify exclusion or simply instrumental approach to the matter. In a democratic Rechtsstaat,the role of criminal law and criminal justice should be generally minimized. An ethics of criminal justice committed to the non-utilitarian questions,the issues of what are good rules for separating legally right from wrong,and what forms of action in the last resort should be offences,that would build on mutual recognition and mutual respect,that would let these ideas penetrate all the levels of criminal justice,would mark a good polity. It would preserve the moral contents of criminal justice without turning it into moralism. It would address people as members of their community,but would leave the legal and moral responsibility for actions to individual people.
