环境污染致害的复杂与不确定性要求必须发挥鉴定人的“法官辅助人”作用,以提升环境司法水平,保障污染受害者的合法权益。但从实践来看,我国鉴定制度有诸多问题,如鉴定机构管理主体不统一、鉴定机构资质混乱和中立性不足、鉴定人聘任与培训存在随机性、收费标准不统一、执业类别不明确、鉴定技术薄弱、有资质的鉴定机构和鉴定人数量偏少或拒绝鉴定。本文分析了我国现行鉴定制度的局限与不足,提出必须完善环境污染损害鉴定管理体制,加强环境监管能力建设。
<<The complexity and uncertainties of harms caused by environmental pollution require that an evaluator must play a role as an assistant to the judge so as to improve environmental justice and to protect the rights of victims of pollution.From a practical perspective,however,China’s evaluation system is faced with numerous problems such as the coexistence of multiple regulators of evaluation organizations,qualification and neutrality problems with evaluation organizations,arbitrary evaluator hiring and training,varying service rates,unclear types of practitioners,inefficient evaluation technologies,insufficient qualified evaluation organizations and evaluators,and refusal of service for various reasons.Relevant authorities must improve the system for managing evaluation on harms caused by environmental pollution,and enhance the capacity of environmental regulation.Only by so doing can they make full use of the evaluation system in alleviating environmental degradation,facilitating changes in the way of economic development,and improving the way of environmental management.
