北京市劳动争议具有劳动报酬争议占据首位、劳动关系争议突出、农民工社保问题严重、工伤问题严峻、群体性案件持续高发等特点。劳动争议解决过程中存在维权证据缺乏、维权成本高、社会保险难以维权等问题。今后的劳动争议会受《劳动合同法》《民事诉讼法》的修改以及《旅游法》出台的影响,并将呈现劳动者权利意识增强、劳动争议数量高发、劳动争议类型多样化、群体性劳动维权趋势明显、多样化劳动争议处理模式并存趋势。
<<According to the data of labor disputes from Beijing arbitrations and courts and Beijing Yilian Legal Aid and Research Center of Labor (hereinafter referred to as Yilian),we find that the labor disputes of Beijing have the following characteristics:the labor compensation dispute toping the list,the labor relation dispute standing out,the social security of migrant workers and the problems of work-related injury being serious and the collective labor dispute sustaining at a high frequency.In the settlement of labor dispute,there are many problems,such as the lack of evidence,the high cost of arbitration and lawsuit,the difficulty in the safeguard of social security and so on.In the future,on one hand,the labor disputes are affected by the amendment of the Labor Contract Law and Civil Procedural Law,and the issue of the Tourism Law;on the other hand,the labor disputes present the tendency as follows:the workers’ awareness of rights strengthening,labor disputes sustaining at a higher number and displaying a great diversification,the collective labor rights protection having a noticeable trend and there coexisting diversified labor dispute resolutions.
