小产权房是在我国城镇化快速推进的背景下多种因素综合作用的产物,尤其是农村集体谋求土地收益最大化的结果。解决小产权房问题的关键,是在确保国家整体利益尤其是18亿亩耕地红线不被突破的前提下,让农民和村集体自主参与城镇化建设,并从中获得更大的利益。为此,应允许城市郊区及快速城镇化地区的农村集体,各自划出一块自留地。在自留地上,村集体拥有绝对所有权。自留地可上市交易,与国有土地“同地、同权、同价”,也可由村集体自行开发、建设和经营,所获收益用于维持自身生存和发展。自留地上的小产权房,允许其合法存在,但不“转正”。非自留地上的小产权房,占用耕地的应拆除,不占用耕地的可“转正”为商品房。
