餐饮服务环节是食品安全全过程监管的重要环节。自《食品安全法》颁布实施以来，餐饮服务监督执法面临着违法责任追究的一些难点问题，本文就《食品安全法》、《食品安全法实施细则》以及相关规章对餐饮服务违法行为法律责任的设定进行梳理和研究，对部分违法行为的法律适用提出建议，旨在切实贯彻和落实《食品安全法》等法律、法规和规章的执行。
<<The supervision on food safety of catering is one of the important process of the entire process of supervision on food safety. Since “The Food Safety Law of PRC” has promulgated，the catering surveillance law enforcement faces some difficulties，this article is attempting to comb and study the catering illegal activity legal liability which are stipulated by “The Food Safety Law of PRC” as well as the related rules and regulations，for the purpose of implementing and carrying out “The Food Safety Law” and other related regulations earnestly.
