中国自2008年以来陆续颁布出台了一系列劳动法律法规,使劳动者的就业权益获得了更多的法律保护。与此同时,国际金融危机和欧洲债务危机的持续蔓延,使全球就业形势总体欠佳,而中国也无法独善其身。本文将讨论放在全球经济增速继续放缓的背景下,以世界主要经济体为考察范围,运用经合组织以及《全球竞争力报告》的相关指标,旨在对中国劳动关系法制的立法以及执行情况作一比较性评估。得出的主要结论是:中国劳动关系立法的严格性适度,近年来日益凸显的失业问题,不应归咎于中国的劳动法制已经过于严格;并且实际上,中国劳动法律在执行环节还存在比较严重的“有法不依”现象。为此,中国一方面要继续坚持更加积极灵活的劳动用工政策,另一方面也应加快《劳动合同法》等就业保护法律的后续立法与政策制定工作;而对于不同就业形式的劳动者,则要在法律制度安排以及执行监管两方面给予侧重考虑。
<<Since 2008,China has implemented a series of labor laws and made its laborer largely protected by law.Based on ill-performing global economy,Chinese unemployment is also critical. This paper constructs an internationally comparative framework in order to assess whether or not Chinese labor laws is over-rigid. It analyzes the extent of seriousness and completeness of employment protection legislation(EPL),and makes use of several indices from OECD and Global Competitiveness Report,and follows with data calculation and institution comparison. This study has found that,firstly,the rigidness of our country’s EPL is decent,but the carry-out of labor law is unsatisfactory. Chinese government may will go on with flexible employment policies,and meanwhile,quicken their improvements and amendments. Lastly,China should effectively handle the abnormal flexibility and make the implement of employment protection law more fairly and adaptable to the whole laborers.
