目前,数字经济蓬勃发展、社会政策需要转型、就业领域日趋扩大,新业态新经济发展迅速。新就业形态从业人员的规模迅猛增长,伤残、死亡事故风险较高,但他们难以确定劳动关系导致不能参加工伤保险,而商业保险不能完全替代新就业形态从业人员的工伤保险保障,现有制度不能完全满足新就业形态下工伤保险发展需要,难以维护其职业伤害保障权益。本报告从稳步推进新就业形态从业人员职业伤害保障工作、探索平台企业参加多样化商业保险保障、强化监督提升权益保障水平等方面提出有针对性的对策建议,探索建立新就业形态从业人员职业伤害保障制度,切实保障劳动者合法权益,推动新业态新经济持续发展。
<<At present,with digital economy booming,social policies need to be transformed. With employment expanding increasingly,the new industry and new economy are developing rapidly. The scale of people working in new employment patterns increases dramatically. Accordingly,the risk of disability and death accidents is high. However,on the one hand,people working in new employment patterns cannot get insured by general work injury insurance due to the less certain labor relations. On the other hand,the commercial insurance cannot completely replace the work injury insurance protection. Therefore,the existing system cannot fully meet the needs of workers in new employment patterns,and it is difficult to protect their rights and interests. This report puts forward targeted countermeasures and suggestions in terms of steadily promoting the protection of work injury for workers in new employment forms,exploring the participation of enterprises in diversified commercial insurance,and strengthening supervision in the protection of rights and interests. It aims to explore the establishment of a sound work injury protection system,effectively protect legitimate rights and interests,and promote the sustainable development of the new economy in new industries.
