Revenue-generating，publicity and sociality are the three characteristics of the lottery public welfare fund in China. It has gone through three stages of initial system construction，systematic standardization and deepening reform. At present，China’s legal system of the use of lottery public welfare fund exists five problems，such as the lack of perfect information disclosure system，decentralized rules of use，unreasonable allocation proportion，laborious approval process，and lack of effective performance appraisal. By comparing and learning from the experience of France，UK and the United States on the legal system of the use of lottery public welfare fund，it is concluded that countries with developed lottery industry have four characteristics，namely perfect legislation，reasonable allocation and use mechanism，complete supervision system and transparent information. Therefore，it is suggested that China should continue to improve the legal basis of the lottery public welfare fund，establish a relatively independent regulatory agency，improve the external supervision，reform the lottery distribution and sales system.
