法官员额制是全面推进司法责任制改革各项工作落地的关键,法官绩效考核制度作为其配套制度,在评价法官审判工作实绩、分配绩效考核奖励、决定法官等级晋升等方面发挥着重要作用。本文通过对成都高新技术产业开发区人民法院(以下简称“高新区法院”)近三年员额法官业绩评价体系的设计过程、效果呈现进行回溯性分析,对体系设计者和法官的博弈心理、行为进行考察,研讨以激励机制为导向的业绩评价体系是否可以达到“法院发展”和“个人成长目标”的协同共振,将以“审判实绩”为中心的法官审判业绩评价体系,转变为以“职业素能”培育为中心的法官成长模式。
<<Against the backdrop of the modernization of the rule of law,the system of specified number of judges is the key to comprehensively promote the implementation of the reform of the judicial responsibility system. As its supporting system,the judge performance appraisal system plays an important role in evaluating the performance of judges’ trials,allocating performance appraisal awards,and determining the promotion of judges. Through the review of the design process,effects and retrospective analysis of the performance appraisal system of judges in High Technology Industrial Development Zone District Court of Chengdu City in the past three years and the reference to theories of organizational behavior,this article made research on the psychology and behaviors of system designers and judges in a view to find out whether the performance appraisal system guided by incentive mechanism can achieve the goals of court development and personal growth. It will be helpful in establishing a judge quality evaluation model with the six professional qualities that judges should possess to achieve the goal of fair and efficient trial of the court as the basis,and quality cultivation and evaluation as the core.
