中国劳动教养制度在维护社会稳定与社会秩序方面曾经起到过积极作用,但由于其内在的固有缺陷对公民基本人权造成了一定的侵犯。随着法治中国建设的持续深入发展,劳动教养制度不仅与我国宪法法律的人权保障要求相背离,而且与国际人权公约的规定相冲突,并在实施中侵犯公民的基本人权。因此,废止劳动教养制度并进行相应的制度改革,成为我国法治建设与人权保障事业发展的必然要求。

With the development of the rule of law construction,the system of education-through-labor not only deviates from human rights protection in the constitutional law,and conflicts with the provisions of the international convention on human rights and infringes upon citizens’ basic human rights in the implementation. Therefore,to abolish the education-through-labor system and carry on the corresponding reform of the system are the necessary requirements of the progress of the rule of law and human rights protection in China.
