    发展中的中国企业人权政策与声明

    摘要

    企业人权政策是企业落实尊重人权责任的基本方针。联合国《工商企业与人权:实施联合国“保护、尊重和补救”框架指导原则》为企业制定人权政策确立了内容要件和形式要件,据此可以将企业人权政策区分为狭义的人权政策和广义的人权政策。近年来,越来越多的中国企业开始制定和发布狭义的企业人权政策,人权政策的质量不断提高,人权政策在企业内外部的影响也持续扩大。同时,中国企业的人权政策在数量、质量和影响力各个维度上仍有很大的改进空间。中国企业人权政策发展的动因,除了企业的使命、价值观或文化等内在驱动力因素之外,主要是政策上的推动力和商业上的拉动力综合驱动。因此,本报告建议中国政府出台更多更有力的国家政策鼓励和引导中国企业以人权政策为基础在国内外履行尊重人权的责任,同时,建议更多中国企业学习已经制定了人权政策的中国企业的经验,研究制定符合自身现状和发展战略的人权政策。

    Abstract

    A corporate human rights policy is the basic guide for an enterprise to implement its responsibility to respect human rights. The United Nations Guiding Principles on Business and Human Rights establishes the content and form requirements for companies to formulate human rights policies,according to which enterprise human rights policies can be divided into narrow human rights policies and broad human rights policies. In recent years,more and more Chinese companies have begun to formulate and publish corporate human rights policies in a narrower sense. Meanwhile,the quality of human rights policies has continued to improve,and the impact of human rights policies on the inside and outside of companies has continued to expand,although there is still a lot of room for improvement in all dimensions including quantity,quality and impacts. In addition to internal driving factors such as corporate mission,values or culture,the development of Chinese corporate human rights policies is mainly driven by a combination of state policy and commercial push. Therefore,this study recommends that the Chinese government introduce more powerful national policies to encourage and guide Chinese enterprises to fulfill their responsibility to respect human rights at home and abroad based on human rights policies. At the same time,it is recommended that more Chinese enterprises learn from Chinese enterprises that have formulated human rights policies and formulate human rights policies in line with their own current situation and development strategies.
