本报告以淮南市法治政府建设为个案,探讨法治政府建设进程中现代行政决策科学化民主化法治化的实践模式和理论逻辑。实践层面,淮南市政府充分发挥法治政府示范创建活动的引领作用,依据“健全依法决策机制,公众参与,专家论证、风险评估,合法性审查,集体讨论决定,强化决策规范化建设”六大框架,积极探索行政决策科学化民主化法治化的本地模式。理论层面,淮南市政府秉持“以人民为中心”的执政理念、新时代依法行政的制度逻辑和“满意原则”目标导向的决策逻辑,实现了对传统行政决策的超越。法治政府建设进程中的实践张力表明,应进一步激活决策能动要素,增强现代化决策意识;加强决策透明化建设,健全公民参与机制;注重制度学习和创新,强化行政决策的规范化、制度化和程序化;促进互动融合,激发科学化、民主化和法治化的协同效应,为“积极探索具有中国特色的法治政府建设模式和路径”贡献经验。
<<Taking the construction of the rule-of-law governm ent in Huainan City as a case,this paper discusses the practical mode and theoretical logic of the scientific democratization of modern administrative decision-making and the rule of law in the process of building a rule-of-law government. At the practical level,the Huainan municipal government gave full play to the leading role of the demonstration and creation of the rule-of-law government,based on the six index systems of improving the legal decision-making mechanism,public participation,expert demonstration,risk assessment,legality review,collective discussion and decision,and strengthening the standardization of decision-making,and actively explored the local model of scientific,democratized,and legalized administrative decision-making. At the theoretical level,the Huainan municipal government adhered to the ruling concept of people-first,the system logic of administration by law in the new era,and the goal-oriented decision-making logic of satisfaction principle,which has achieved the transcendence of traditional administrative decision-making. The practical tension in the process of building a rule-of-law government shows that the dynamic elements of decision-making should be further activated,and the awareness of modern decision-making should be enhanced;efforts should be made to promote interaction and integration,stimulate the synergistic effect of scientific,democratization and rule of law,and contribute experience to actively explore the construction model and path of the rule-of-law government with Chinese characteristics.
