To protect the life and health of the public,China has long established rules and regulations,and has successively promulgated the Drug Administration Law,the Regulations for the Implementation of the Drug Administration Law,the Advertising Law and other laws and regulations and relevant provisions. China issues administrative licenses for drug production and marketing,and advertising review licensing and off-site releasing and filing are required before drug advertisement is released. In the management system,the advertising reviewing agencies and regulatory agencies are separated. In advertising management,advertising for specific drugs,specific advertising content,and advertising spokespersons are all prohibited in drug advertising. However,there are still shortcomings in drug advertising in terms of advertising reviewing licensing,off-site releasing and filing,scope of prohibited items,regulatory coordination,and transparency of administrative law enforcement. Efforts shall be made to delegate the power of drug advertising reviewing licensing to the corresponding administrative departments at the county level,establish different review and regulatory authorities according to the differences between prescription drugs and over-the-counter drugs,cancel the off-site releasing and filing of drug advertising,establish a more comprehensive regulatory coordination mechanism and increase the transparency of administrative law enforcement.
