本报告建立了一套相对完整的条约约束力评价体系,通过对条约文本进行定量分析,研究中国与东盟国家签订的43项海洋条约的约束力。研究得出,2020年中国与东盟国家签署的海洋条约中,双边条约约束力高于多边条约约束力,不同国家条约的约束选择不尽相同;在海洋多边条约中,菲律宾的约束力最高,而新加坡最低;在海洋双边条约中,泰国的约束力最高,而柬埔寨最低;在双边海运协定中,泰国、越南的条约约束力较高,而新加坡、马来西亚的条约约束力较低。目前,中国与东盟国家签署的海洋多边和双边条约的约束力均值呈现平稳中略有下降的趋势,因而中国与东盟国家应积极推动双边和多边海洋合作条约的制定,为区域海洋合作创造良好的制度保障和法律环境。
<<This Report estimates the binding force of 47 maritime treaties signed between China and ASEAN countries by establishing a relatively complete evaluation system of binding force of treaties and quantitative analysis of treaty texts. It is concluded that the binding force of bilateral treaties is higher than that of multilateral treaties among the maritime treaties signed by China and ASEAN countries,and the binding force of treaties are different in countries. In terms of the binding force of maritime multilateral treaties,the Philippines scores highest,while Singapore is the lowest. In bilateral maritime treaties,Thailand is the highest and Cambodia is the lowest;In bilateral maritime agreements,the treaty binding force of Thailand and Vietnam is the highest,while the treaty binding force of Singapore and Malaysia is low. At present,the annual change of the average binding force of multilateral and bilateral maritime treaties signed by China and ASEAN countries is in a steady and slightly decreasing trend. Therefore,China and ASEAN countries should actively promote the formulation of bilateral and multilateral maritime cooperation treaties to create a good institutional guarantee and legal environment for the regional maritime cooperation.
