知识产权保护是衡量和评价一个国家和地区营商环境状况的重要指标。新时代中央和地方对知识产权保护工作的重视程度空前,如何系统整合现行知识产权分散、单行的法律法规规范,开展知识产权保护综合性立法,为全面加强知识产权保护提供法治保障,成为当前立法理论和实践中的热点难点问题。深圳、天津分别先行运用经济特区立法权和省级地方立法权进行了探索和尝试。本文在地方开展知识产权保护综合立法的背景下,对地方知识产权保护综合立法的立法思路和内容创新以及需要注意把握的问题进行初步探讨,以期对地方层面以及未来国家层面开展知识产权综合立法提供参考。
<<Intellectual property protection is an important indicator to measure and evaluate the business environment of a country or region. In the new era,the central and local governments attach unprecedented importance to the protection of intellectual property rights. How to systematically integrate the existing scattered and separate laws and regulations of intellectual property rights,carry out comprehensive legislation of intellectual property rights protection,and provide legal guarantee for comprehensively strengthening the protection of intellectual property rights have become a new hot and difficult issue in the current legislative theory and practice. Shenzhen and Tianjin have explored and tried using the legislative power of the special economic zone and the provincial local legislative power respectively. Based on the background of local comprehensive legislation on intellectual property protection,this paper makes a preliminary discussion on the legislative ideas,content innovation and problems that need to be paid attention to,in order to provide reference for local and future national comprehensive legislation on intellectual property protection.
