自动驾驶汽车在国内早已步入公共道路测试阶段,部门规章与各地方的规范性文件构成现行路测法律规制体系。自动驾驶汽车道路测试规范对测试主体、测试车辆、测试驾驶人、测试申请、测试管理以及测试审核加以规定。但现有规范与自动驾驶自动化分级国家标准适配度不高;规范层级较低并与多部法律存在冲突。并且结合自动驾驶汽车道路测试到商用化的发展进路来看,技术发展与法律规范间存在一定的“紧张”关系,相关问题的解决仍依赖法律制度的持续更新。在国家统一立法条件还不成熟的背景下,结合《立法法》相关规定,地方试点、先行立法的试验立法具有可行性。而在地方立法制定过程中应秉持“试验性”和“渐进性”的立法思路,并在立法内容上重视安全与监管。
<<Autonomous vehicles have already entered the public road testing stage in China,and departmental regulations and local normative documents constitute the current legal and regulatory system for road testing. Autonomous vehicle road test specifications stipulate the test subject,test driver,test vehicle,test application,test review,and test management. However,the existing specifications are not highly compatible with the national standards for the classification of automatic driving automation;the level of specifications is low and conflicts with many laws. And combined with the development approach from road testing of autonomous vehicles to commercialization,there is a certain “tension” relationship between technological development and legal regulations. The resolution of related issues still relies on the continuous updating of the legal system. Under the background that the conditions for national unified legislation are still immature,combined with the relevant provisions of the Legislation Law,experimental legislation for local pilots and advance legislation is feasible. In the process of making local legislation,the legislative thinking of “experimental” and “gradual” should be upheld,and safety and supervision should be emphasized in the content of legislation.
