    深圳行政裁量基准设定研究

    摘要

    行政裁量基准是行政机关依职权对法定裁量权具体化的控制规则。深圳最早于2008年颁布了《深圳市规范行政处罚裁量权若干规定》,市、区两级政府部门制定了大量的行政裁量基准文件,主要分布在行政处罚与行政许可领域。当前,行政裁量基准的设定存在着标准不统一、程序不完善、变更规则缺失等突出问题。行政裁量基准设定规则的完善需要吸纳《行政处罚法》中的新规定,同类型行政裁量基准设定所依据的法律规范应当一致,针对违法主体、违法情节以及违法行为手段等的考量因素应当大体一致,要完善行政裁量基准设定程序,并确立行政裁量基准变更规则。

    Abstract

    The benchmark of administrative discretion is the control rule that the administrative organ embodies the statutory discretion according to its power. In 2008,Shenzhen government promulgated Several Provisions of Shenzhen Municipality on Regulating the Discretionary Power of Administrative Punishment. Municipal and district government departments have formulated a large number of administrative discretion benchmark documents,mainly in the fields of administrative punishment and administrative licensing. At present,there are some outstanding problems in the formulation of administrative discretion benchmarks,such as inconsistent setting standards,imperfect setting procedures,and lack of changing rules. The improvement of the setting rules of administrative discretion benchmark needs to absorb the new provisions of the Administrative Punishment Law;unify the standards for setting administrative discretion benchmarks,the legal norms on which the same type of administrative discretion benchmarks are set should be consistent,and the consideration factors for illegal subjects,illegal circumstances,and illegal behavior methods should be roughly the same;improve the procedures for setting administrative discretion benchmarks,and establish the rules of administrative discretionary benchmark changes.
